A arbitrator must decide if charges may be filed against jailer Robert Gordon Martin III, 27 of Mackerel Drive in Gautier, who was taken into custody Friday morning.

A female inmate who had been in the city jail for about a week claims the couple had consensual sex Monday night while Martin was upon duty. Sex between jailers and their captives is a gross offence offense in Mississippi.

Pascagoula Police Department Lt Davey Davis said Martin resigned Tuesday.

"When he came to work they questioned him about it and he resigned immediately," Davis said.
